Description
This book is a study of the law and practice of states of emergency in India since independence. The analysis is set in the context of both legal provisions and international norms and makes extensive reference to national and international case law including decisions, resolutions and determinations of relevant United Nations bodies. While tracing the origins of the appropriate constitutional provisions, the author elaborates on the various laws and measures adopted on three occasions when these provisions were invoked to deal with real or perceived threats to the security and integrity of India. It also offers a comprehensive treatment of a fourth, de facto, resort to emergency powers in the late 1980s and early 1990s when separatist movements in Punjab, Jammu & Kashmir and the northeastern states led to large-scale acts of insurgency and violence.
